issued the opinion to explain his Oct. 21 decision to set free a Miami Herald reporter jailed Oct. 7 for refusing to answer questions about his 1994 jailhouse interview with John Zile, who is on trial this week in Bartow on a charge of first-degree murder in his stepdaughter's death. Ferguson's 10-page explanation says David Kidwell was jailed because some Florida appellate courts have adopted a misguided "blanket rule" that journalists cannot claim special protection, or privilege, unless they are protecting a confidential source. But Ferguson said the privilege should ing," that could make it "almost impossible" for new groups to ever start a charter school, said Al Milligan of Global Institute, a group that wants to start a private school and eventually turn it into a charter school.

Milligan is troubled that the board policy won't be ready in time to open a charter school in fall 1997. But state law requires the district to consider any charter school proposal submitted. The policy is scheduled to be finished by spring because the district's staff still must review all parts of the policy, then the board will review it and residents will have time to comment. The draft is based on policies and lessons learned in other districts.
