About $110 million of that would go for resurfacing, but Stevens said it was even more critical to replace equipment in toll plazas. "We can continue this costly process of refurbishing and continue in the Stone Age, or we can buy new equipment that will last another 20 years," he said, adding the original manufacturer of the cast-iron toll machines no longer is in business, and replacement parts often must be custommade. TALLAHASSEE (AP) Claiming the Florida Turnpike has enough money to keep it operating, attorneys for Broward County asked a hearing examiner yesterday to forbid the Department of Transportation from increasing tolls on the 265-mile expressway. Kenneth G.

Oertel, a Tallahassee attorney representing Broward, challenged the validity of a rule proposed by DOT that would allow it to hike tolls an average 12 percent on the roadway that stretches from Homestead north to Wildwood in Sumter County. It would be the first toll increase in the 22-year history of the turnpike. "We're saying they have enough money to live with," Oertel said, noting that the turnpike ended 1977 with a $600,000 surplus even though DOT officials had predicted a deficit. His petition said any increase would make the turnpike "a parkway for the privileged," forcing the less affluent to use secondary roads. Broward attorney Barry Lessinger of Fort Lauderdale added that the turnpike already is $2 million ahead of its projections for 1978.

He said any toll increase would have adverse effects in populous Broward, increasing traffic on crowded 1-95. "The biggest impact on Broward County would be a fact that DOT officials acknowledge for every 10 percent increase in tolls, there is a 2 percent drop in traffic," Lessinger said. "That's maybe 20,000 cars per day that would leave the Broward section. "They're going to take traffic from the turnpike and dump it on other north-south arterials already crowded." R.W. Stevens, DOT toll facilities engineer, said the department's original intention when it ordered a study of tolls was to make them more uniform.

Currently, motorists in the northern sections pay 1.8 cents per mile but in southern areas about 4 cents per mile. Stevens said that the department decided to hike tolls only after a New York consulting firm predicted a deficit for 1977. The survey revealed: A high markup on 100 tablets of hydrochlorothiazide, a diuretic also marketed under the brand name Hy-drodiuril.

The 100 tablets have a wholesale price of 76 cents. Roberts Drug Store near downtown Miami charged $5.75 a 675 percent markup. Hydrodiuril sold at Roberts for $10.75, a higher retail price but reflecting a lower markup, 76 percent, from a brand-name wholesale price of $6.10. An Eckerd store marked up the same generic drug by 503 percent to $4.28. It sold the brand name for a 9 percent markup.

Chlordiazepoxide, the equivalent of a tranquilizer, Valium, sold at a Grand Rx store for $5.95 for 100 10-milligram capsules, a 467 percent markup from the Red Book price of $1.50. The store sold Valium for 2 percent above the $7.82 wholesale cost. Achromycin, an antibiotic, sold at Karlin's Drug Store on Miami Beach for $7.95, up 76 percent over the wholesale price of $4.51 for 100 250-milligram capsules. The public paid the same price for the same amount of tetracycline, the generic equivalent. That is 476 above the generic wholesale cost of $1.38.

MIAMI (AP) Instead of saving money for consumers as intended, Florida's new generic-drug law is creating windfall profits for some druggists, according to a survey by the Miami Herald. In one case, the newspaper says, a drug was marked up 657 percent. The Herald said Sunday that some druggists said they had to mark up prices of generic drugs which carry only the name of their chemical makeup because of increased costs in complying with the law. "That's bull" says Rep. John Con-sidine, co-author of the law.

He said the law is being broken. The Herald said it was told by one pharmacist, who asked not to be identified, that others have learned that they can give generic drugs high markups and still make them look cheaper than brand-name equivalents. "The law was a boon to retailers," he said. "They can charge 400 percent, because on a low wholesale cost it still looks less (than the brand markup). It is an enormous profit."
