THE PALM BEACH POST SATURDAY, FEBRUARY ll, 2006 DUI-test case has officials holding breath Briny Breezes, Gulf Stream officials file for reelection By SUSAN SPENCER-WENDEL Palm Beach Post Staff Writer WEST PALM BEACH Hexadecimals, source codes, software: it is an excruciatingly technical argument potentially striking at the heart of DUI cases the breath test results. But an argument that has prosecutors "greatly concerned" for its potential effect upon roughly 1,500 DUI cases in Palm Beach County. The effort by criminal defense attorneys is spreading statewide and landed at the county's door Friday. Defense attorneys are taking aim at the breath-testing machine's computer system, demanding to know its inner workings. A trio of judges sat scrunching brows as they heard testimony of algorithms and hexadecimals and such, how a tweak in one bit could alter the function of the machine.

The gallery was packed with curious lawyers. Defense attorneys, led by Bryan Gabriel, are asking the judges to order prosecutors to produce the "source code," the computer blue print for how the machine, the Intoxilyzer 5000 works. The machine is used in breath-tests all over Florida But they know what the prosecutors' answer will be: we don't have it The manufacturer of the machine routinely has refused to divulge it, even to prosecutors, claiming it is a trade secret It's a DUI deadlock that in other counties like Orange and Sarasota has thrown hundreds of breath-test results out of cases, tanking an untold number of cases. It has Chief Assistant State Attorney Ted Booras "greatly concerned," he said. Booras estimates his office could potentially lose about 1,500 cases if judges here ride in favor of the defense.

An alcohol-testing specialist from the Florida Department of Law Enforcement emphasized to the panel that the machines are strictly maintained and the "code" is unnecessary to check accuracy. In Briny Breezes, Mayor Jack Lee filed. Lee, 56, is in private psychotherapy practice.

He is married with three grown children. He moved to the park with his parents in 1958. He left in 1974 and spent two decades in Chicago, then bought his parents' home when they died in 1996. In Gulf Stream, Commis sioners Muriel Anderson and Chris Wheeler filed Friday. Both were appointed last year when commissioners moved away.

Anderson, 68, is a Realtor. She is married with three grown children. She served on the town's architectural review board before replacing William Lynch. Wheeler, 49, retired in October as chief executive of Gables Residential Trust in Boca Raton. He is married with no children.

She attended the University of Maryland in College Park, graduating in 1941 and was a member of Delta Delta Delta Sorority. After graduation, Dorothy studied at Smith College to complete training to become a Navy WAVE.

Assigned to the Washington Navy Yard, she rose to the rank of Lieutenant and became Head of Personnel in the Ships History Department. In 1948 she married Hyattsville attorney, Nicholas Orem, Jr. They were married until his death in 2002. Shortly after their marriage, they settled in University Park and lived there until 1 969 when they moved to Chevy Chase. They also maintained homes in Ocean City, MD and West Palm Beach, FL Dorothy studied painting and became a prolific artist, creating more than 100 watercolor and oil paintings for which she won many prizes and honorable mentions.

She supported the efforts of the National Symphony Orchestra, the Washington Cathedral, Stratford Hall and many others, she was a member of The Washington Club, the Columbia Country Club, the University Park Women's Club, and the Kenwood Garden Club. Mr. and Mrs. Orem were long supportive of the University of Maryland and the Terrapin Club. Their generosity extended to the endowment of the Nicholas Orem BannekerKey Scholarship and the Nicholas and Dorothy Dennis Orem Fund in memory of Mrs.

Orem's father Girard College Chemistry Professor Showell C. Dennis. Dorothy belonged to Woodbury Presbyterian where she was married, First Presbyterian, founded by her grandmother, Ella P. Dennis, in Ocean City, MD, the University Park Presbyterian and the National Presbyterian Church which she attended for over 30 years.
